By accessing or using kyuu ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
kyuu is a web-based process simulation platform. We provide tools to build, simulate, and analyze process flowsheets. The Service is offered in a free tier and a paid "Pro" tier.
To use kyuu, you must create an account. You are responsible for:

We reserve the right to modify free plan limits with reasonable notice.
The Pro plan is a paid subscription providing unlimited access to all features. Payment is processed through Stripe. Subscriptions renew automatically unless cancelled before the end of the billing period.
The Enterprise plan is available for organizations with custom requirements, including volume licensing, on-premise deployment, and dedicated support. Terms are defined in individual agreements.
Pro subscriptions are billed monthly. You may cancel at any time; your access continues until the end of the current billing period. We do not offer prorated refunds for partial months.
All prices are listed in Euros and include applicable taxes where required by law.
You retain full ownership of all simulation data, flowsheets, and results you create using kyuu. We do not claim any intellectual property rights over your content.
Your simulation data is encrypted end-to-end. We cannot access it. See our Privacy Policy for details on how we handle your data.

We strive to maintain high availability but provide the Service "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation.
We are not liable for any data loss that occurs due to factors outside our control, though we take extensive measures to prevent such events.
To the maximum extent permitted by law, kyuu shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
You may delete your account at any time. We may suspend or terminate your access if you violate these Terms, with notice where practicable.
Upon termination, your encrypted simulation data will be permanently deleted within 30 days.
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be resolved in the courts of Hamburg, Germany.
